Terms of Service

Welcome to Emerge Berkeley Christian Academy (EBCA). These Terms of Service (“Terms”) outline the expectations, responsibilities, and agreements between EBCA, our students, and their families. By enrolling your child, accessing our website, or participating in any EBCA program, you acknowledge that you have read and agree to these Terms.

1. Enrollment and Admission

  • Admission to EBCA requires completion of the enrollment process, payment of registration fees, and agreement to abide by academy policies.

  • EBCA reserves the right to deny or revoke admission if false information is provided, if payments are not maintained, or if policies are violated.

  • Parents/guardians are responsible for ensuring that required documents (medical, academic, emergency contacts) are accurate and up to date.

2. Tuition and Fees

  • Tuition rates, payment schedules, and fee structures are outlined in the EBCA Tuition Agreement.

  • Payments must be made on time; late or missed payments may result in penalties, suspension of services, or dismissal.

  • Tuition and fees are generally non-refundable, except in cases outlined in the Tuition Agreement or state law.

3. Code of Conduct

  • EBCA is committed to fostering a Christ-centered, safe, and respectful learning environment.

  • Students, families, and staff are expected to uphold biblical values of respect, honesty, kindness, and integrity.

  • Bullying, harassment, disrespectful behavior, or disruption of the school community will not be tolerated.

  • Disciplinary actions, including suspension or expulsion, may be taken for violations of the Code of Conduct.

4. Academic Standards

  • Students are expected to engage fully in learning and complete assignments with integrity.

  • Academic dishonesty (cheating, plagiarism, or misrepresentation of work) may result in disciplinary action.

  • EBCA reserves the right to adjust curriculum, schedules, and teaching methods to best serve student learning and development.

5. Technology and Online Services

  • EBCA provides technology and internet access for educational purposes only.

  • Misuse of school technology — including accessing inappropriate content, cyberbullying, or attempting to bypass security measures — may result in loss of privileges or further discipline.

  • Parents/guardians consent to EBCA’s use of approved online learning platforms as part of the academic program.

6. Health, Safety, and Emergency Care

  • Parents/guardians must inform EBCA of any medical conditions, allergies, or special needs.

  • In the event of a medical emergency, EBCA is authorized to seek treatment for a student if parents/guardians cannot be reached.

  • EBCA follows local, state, and federal guidelines regarding student health and safety.

7. Privacy and Student Records

  • EBCA collects and maintains student information in accordance with our [Privacy Policy] https://www.emergebca.org/privacy.

  • By enrolling, families consent to the responsible use of student data for academic, administrative, and safety purposes.

  • EBCA may use photos, videos, or student work for promotional or educational purposes with prior parental consent.

8. Limitation of Liability

  • EBCA takes reasonable precautions to provide a safe environment.

  • To the extent permitted by law, EBCA, its staff, and affiliates are not liable for injuries, damages, or losses arising from participation in school activities, except in cases of gross negligence or intentional harm.

9. Changes to Programs or Policies

  • EBCA reserves the right to update academic programs, schedules, or policies as needed.

  • Families will be notified of significant changes through official school communication channels.

10. Termination of Enrollment

  • EBCA may suspend or terminate a student’s enrollment for nonpayment, violation of school policies, or behavior inconsistent with the mission of the academy.

  • Parents/guardians may also withdraw their child by following the withdrawal procedures outlined in the Tuition Agreement.

11. Governing Law

  • These Terms are governed by the laws of the State of California.

  • Any disputes arising under these Terms shall be resolved in the courts located in Alameda County, California, unless otherwise required by law.
